Texas contract deadline on a weekend: what moves and what doesn’t
A Texas contract deadline on a weekend only moves for earnest money and the option fee under TREC 20-19. See what stays put, with 2026 holiday dates.

If you have ever wondered whether a Texas contract deadline on a weekend slides to Monday, the answer under the current TREC resale contract is “only some of them.” The form names exactly which deadlines move, and the one agents worry about most, the end of the option period, is not on that list.
Quick answer: Under TREC 20-19, only the deadlines to deliver the earnest money, the option fee and any additional earnest money are extended when the last day falls on a Saturday, Sunday or Legal Holiday. They move to the end of the next day that is none of those. The option period, financing deadlines, objection periods and closing do not move.
Which Texas contract deadlines extend for a weekend or holiday?
Paragraph 5A(2) of the TREC One to Four Family Residential Contract (Resale), form 20-19, says that if the last day to deliver the earnest money, option fee or additional earnest money falls on a Saturday, Sunday or Legal Holiday, the time to deliver is extended until the end of the next day that is not a Saturday, Sunday or Legal Holiday.
- These extend: earnest money and option fee (due within 3 days after the Effective Date) and additional earnest money (the number of days written in paragraph 5A(1)).
- These do not extend: the option period, Buyer Approval under the Third Party Financing Addendum, Property Approval (on or before the 3rd day before closing), title and survey objection periods, the termination window after a late Seller’s Disclosure Notice, and the Closing Date.
Paragraph 5E adds that time is of the essence for paragraph 5. That extension is the only slack the form gives you.
What time does a Texas contract deadline end?
The contract sets a clock time for one deadline. Option period termination notices must be given by 5:00 p.m. local time where the property is located, on the last day. For the three payments, the extension runs “until the end of the next day,” with no clock time stated. In practice the cutoff is when the escrow agent can receive the funds, so ask the title office for its holiday hours.
Days are calendar days, and the count starts the day after the Effective Date. Our Texas option period post walks through that count and the 5:00 p.m. rule, so we won’t repeat it here.
Does the Texas option period extend if it ends on a weekend?
No. The option period is a number of days after the Effective Date, with notice due by 5:00 p.m. on the last one. If that day is a Saturday, the deadline is Saturday at 5:00 p.m. If it is Thanksgiving, the deadline is Thanksgiving at 5:00 p.m.
Around holidays this produces an odd result. The option fee deadline can land after the option period has ended, so the fee is still on time but the window to terminate has already closed.
What counts as a Legal Holiday in a TREC contract?
Form 20-19 capitalizes “Legal Holiday” and defines it as a legal holiday described in Sections 662.003(a) and 662.003(b)(4) and (6) of the Texas Government Code. That is the nine national holidays in 662.003(a), plus Emancipation Day on June 19 and the Friday after Thanksgiving.
| Legal Holiday | 2026 date |
|---|---|
| New Year’s Day | Thu, Jan 1 |
| Martin Luther King Jr. Day | Mon, Jan 19 |
| Presidents’ Day | Mon, Feb 16 |
| Memorial Day | Mon, May 25 |
| Emancipation Day in Texas | Fri, Jun 19 |
| Independence Day | Sat, Jul 4 |
| Labor Day | Mon, Sep 7 |
| Veterans Day | Wed, Nov 11 |
| Thanksgiving Day | Thu, Nov 26 |
| Friday after Thanksgiving | Fri, Nov 27 |
| Christmas Day | Fri, Dec 25 |
Not on the list: Columbus Day, December 24, December 26, and optional state holidays such as Texas Independence Day and San Jacinto Day. The definition names actual dates and says nothing about observed days, so don’t assume a deadline moves because an office closes on a nearby weekday. Files still on the older 20-18 form are less clear, because that version used a lowercase “legal holiday” with no definition.
How does a TREC deadline work around Thanksgiving 2026?
Say the Effective Date is Monday, November 23, 2026, with a 5-day option period and additional earnest money due within 10 days.
| Deadline | Last day on paper | Actual deadline |
|---|---|---|
| Earnest money and option fee (3 days) | Thu, Nov 26 (Thanksgiving) | End of Mon, Nov 30 |
| Option period (5 days) | Sat, Nov 28 | Sat, Nov 28 at 5:00 p.m., not extended |
| Additional earnest money (10 days) | Thu, Dec 3 | Thu, Dec 3, no extension needed |
Two Legal Holidays and a weekend push the payment deadline to Monday, but the option period still ends Saturday afternoon. Deliver the funds before the holiday and get the buyer’s decision by Saturday at 5:00 p.m.
What about Christmas and New Year’s 2026?
| Effective Date | 3rd day | Earnest money and option fee due |
|---|---|---|
| Mon, Dec 21, 2026 | Thu, Dec 24 | Thu, Dec 24 (Christmas Eve is not a Legal Holiday) |
| Tue, Dec 22, 2026 | Fri, Dec 25 | End of Mon, Dec 28 |
| Tue, Dec 29, 2026 | Fri, Jan 1, 2027 | End of Mon, Jan 4, 2027 |
The option period ignores all of this. On the December 22 file, a 7-day option ends Tuesday, December 29 at 5:00 p.m. On the December 29 file, a 10-day option ends Friday, January 8, 2027 at 5:00 p.m. The December 21 file is the one that bites: plenty of offices close early on Christmas Eve, and the contract gives no extra day for it.
How should you calendar these deadlines on a live file?
- Calendar the unextended last day for every deadline. Add the extended date only for the three payments.
- Treat the option period as a hard 5:00 p.m. on its written day, weekend or not.
- Confirm the escrow agent’s holiday hours in writing as soon as the contract is effective.
- Don’t write a Closing Date on a weekend or Legal Holiday. The form won’t move it for you.
Our free Texas closing deadline calculator applies these rules. It moves only the payment deadlines, flags the rest, and exports a calendar file or spreadsheet. The executed contract always controls, so confirm every date with the agent, broker or attorney on the file. If you would rather hand the whole calendar off, our Texas transaction coordinators track these dates on every file, with an AI layer from ReBillion drafting the timeline and a human coordinator checking each date.
Frequently asked questions
Does the Texas option period get extended if it ends on a Sunday?
No. Under TREC 20-19 the option period is not extended for a weekend or Legal Holiday. The buyer’s termination notice must be given by 5:00 p.m. local time on the last day of the period, even when that day is a Saturday, Sunday or holiday. Only the earnest money, option fee and additional earnest money deadlines move.
Is Christmas Eve a legal holiday for a TREC contract deadline?
No. TREC 20-19 defines Legal Holiday by pointing to Texas Government Code 662.003(a) and (b)(4) and (6). That list includes Christmas Day and the Friday after Thanksgiving, but not December 24 or December 26. A payment that is due on Christmas Eve is due that day, so plan around early office closings.
When is earnest money due if the third day is Thanksgiving?
If the Effective Date is Monday, November 23, 2026, the third day is Thanksgiving. Thanksgiving and the Friday after are both Legal Holidays, and a weekend follows, so the earnest money and option fee are due by the end of Monday, November 30, 2026. Delivering before the holiday is the safer plan.
Does a closing date on a weekend move to Monday in Texas?
Not under the contract. TREC 20-19 has no weekend or holiday rule for the Closing Date; it is the date written in paragraph 9A. Pick a day the title company is open when you write the contract, and if the date has to change, amend it in writing signed by both parties.
