What happens when a real estate deadline falls on a weekend
When a real estate deadline falls on a weekend, some state forms move it to the next business day and others do not. Compare the rules, state by state.

When a real estate deadline falls on a weekend, everyone on the file wants to know whether they get until Monday. The contract form decides, and the forms disagree. Some move weekend and holiday deadlines to the next business day, some say in plain words that nothing moves, and some say nothing at all.
Quick answer: It depends on the form. Florida, Washington and Tennessee forms move most weekend or holiday deadlines to the next business day. Texas, Georgia, North Carolina and Arizona forms do not, apart from narrow exceptions such as Texas earnest money or Georgia’s closing date. Colorado leaves it to a checkbox. Never assume Monday.
Do real estate deadlines move to Monday if they land on a weekend?
Only if the contract or a statute says so. There is no general rule that a weekend deadline rolls forward. Each state’s standard form sets its own rule, and the rule is often different for different deadlines in the same form.
Before you build the timeline, find the time or computation paragraph in the form. Then mark each deadline as “moves” or “does not move.”
Which state forms move weekend deadlines and which do not?
| State and form | Deadline on a weekend or holiday | Exceptions |
|---|---|---|
| Florida, FR/BAR AS IS | Moves to 5:00 p.m. on the next business day | Holidays are national legal holidays under 5 U.S.C. 6103 |
| Washington, NWMLS Form 21 | Moves to the next day that is not a weekend or RCW 1.16.050 legal holiday | Not the possession date; periods of 5 days or less skip weekends entirely |
| Tennessee, RF401 | Moves to the next business day (federal holidays) | Not the Closing Date, possession, repair completion or offer expiration |
| Texas, TREC 20-19 | Does not move | Earnest money, option fee and additional earnest money delivery do move |
| Georgia, GAR F201 | Does not move | Closing date only |
| North Carolina, Form 2-T | Does not move; days include weekends and holidays | None |
| Arizona, AAR Residential Resale | Does not move | Close of escrow moves to the next day escrow and the recorder are both open |
| Colorado, CBS1 | Moves only if “Will” is checked in Section 3.3.3 | If neither box is checked, deadlines do not move |
The other forms we track split the same way. California’s RPA moves any deadline, close of escrow included, off a Saturday, Sunday or legal holiday. New Mexico’s NMAR form moves deadlines written as a number of days but not deadlines written as a specific date. Utah’s REPC, Louisiana’s mandatory form, Wisconsin’s WB-11 and Oklahoma’s uniform contract do not move ordinary deadlines.
The Texas rule trips up the most agents. Our post on the Texas option period clock covers why the option fee can roll while the option period cannot. You can read the clause yourself in Paragraph 5 of the TREC 20-19 contract.
What happens if the form says nothing?
Some forms have no general weekend rule. The New Jersey Form 118 version we reviewed has none outside attorney review, and we found no general extension in the Minnesota REALTORS purchase agreement. In those cases, state law may supply a default:
- In New York, General Construction Law Section 25 lets payment or performance due under a contract on a Saturday, Sunday or public holiday happen on the next business day, unless the contract shows a different intent.
- In Massachusetts, M.G.L. c. 4, Section 9 lets an act due on a Sunday or legal holiday be performed the next business day. Saturdays are not covered.
Those statutes do not apply everywhere, and a contract can override them. When a form is silent, treat the written date as the deadline and get a signed extension if you need more time.
Why is closing often treated differently?
Closing depends on offices that keep business hours. The deed has to record, the lender has to fund and the title company has to disburse. A Sunday closing date is often impossible to perform, so many forms give closing its own rule:
- Georgia’s F201 moves the closing date and nothing else.
- Wisconsin’s WB-11 moves closing to the next Business Day if it falls on a weekend or a federal or state holiday.
- Illinois’s Multi-Board 8.0 moves the Closing and the Financing Contingency Date to the next Business Day.
- Arizona moves close of escrow to the next day the escrow company and the county recorder are both open.
The opposite also exists. Tennessee’s RF401 moves most deadlines but not the Closing Date, and the contract expires at 11:59 p.m. local time on that date. The Texas closing date does not move either. Check closing separately from every other date.
Worked example: one Saturday deadline in six states
A contract has an effective date of Wednesday, November 4, 2026, and a negotiated 10-day inspection, option or due diligence period. Day 1 is Thursday, November 5. Day 10 is Saturday, November 14, 2026.
| State and deadline | Moves? | When it ends |
|---|---|---|
| Florida inspection period | Yes | Monday, November 16, 2026, 5:00 p.m. |
| Washington inspection period | Yes | Monday, November 16, 2026, 9:00 p.m. |
| Tennessee inspection period | Yes | Monday, November 16, 2026 |
| Texas option period | No | Saturday, November 14, 2026, 5:00 p.m. local time |
| Georgia due diligence period | No | Saturday, November 14, 2026, 11:59 p.m. Georgia time |
| Arizona inspection period | No | Saturday, November 14, 2026, 11:59 p.m. Arizona time |
That is a two-day gap on the same count. A buyer’s agent in Georgia who assumes the period runs to Monday has lost the free walk-away right by Sunday morning. In North Carolina, the due diligence period ends on a date written into the contract; if that date is a Saturday, it ends Saturday at 5:00 p.m.
How should you handle a weekend deadline on a live file?
- Flag every deadline that lands on a Saturday, Sunday or holiday the day the contract comes in, not the week it is due.
- For deadlines that do not move, plan to finish by Friday.
- For deadlines that do move, note the new time as well as the new date. Florida’s extended deadline ends at 5:00 p.m., not midnight.
- If the parties want more time, put it in a signed amendment before the deadline passes.
The free closing deadline calculator moves a deadline only when the state’s form says so and flags the rest. The executed contract controls, so confirm every date with the agent, broker or attorney on the file.
Frequently asked questions
Does the Texas option period extend if it ends on a weekend?
No. Under the TREC resale contract, only the deadlines to deliver the earnest money, the option fee and any additional earnest money move when the last day is a Saturday, Sunday or Texas Legal Holiday. The option period itself does not move, and termination notice is due by 5:00 p.m. local time where the property is located on the last day.
Does a Florida inspection deadline move if it ends on a Sunday?
Yes, under the Florida Realtors/Florida Bar contracts. A time period that ends on a Saturday, Sunday or national legal holiday under 5 U.S.C. 6103 extends to 5:00 p.m., where the property is located, on the next business day. The Florida Realtors-only CRSP contract counts differently, so check which form the parties signed.
What if my contract does not say what happens on a weekend?
Then state law may fill the gap, and it varies. New York’s General Construction Law lets contract performance due on a Saturday, Sunday or public holiday happen the next business day unless the contract shows a different intent. Massachusetts covers Sundays and legal holidays but not Saturdays. Ask the broker or attorney, and get any extension in writing.
Does closing move if it falls on a holiday?
It depends on the form. Georgia’s F201 moves only the closing date. Wisconsin’s WB-11 moves closing to the next Business Day, and Arizona moves close of escrow to the next day both escrow and the recorder are open. Tennessee’s RF401 does not move the Closing Date, and the contract expires at 11:59 p.m. that day.
