Once it passes, most contracts treat the buyer as committed, loan or no loan. On a coordinator’s calendar, few dates can cost a client more money.

Quick answer: The financing contingency deadline is the date by which a buyer must deliver written notice to terminate if the loan is not approved. The contract sets it: 17 days by default in the C.A.R. form, 30 in Florida’s AS IS contract, 21 in NWMLS Form 22A, and a blank in Texas. Miss it and the protection usually ends.

What does a financing contingency protect?

It protects the buyer’s deposit if the lender will not fund the loan described in the contract. Many forms split the loan from the property.

Texas is the clearest case. The TREC Third Party Financing Addendum (TREC No. 40-11) has Buyer Approval, which is about the buyer’s credit, income and assets, and Property Approval, which covers the appraisal, insurability and lender-required repairs. Colorado’s 2026 contract separates the New Loan Terms Deadline from the New Loan Availability Deadline, and says the availability right cannot be used for reasons tied to loan terms, appraised value, lender property requirements or insurability.

How long is the financing contingency in common state forms?

State

Form

Financing deadline

Weekend or holiday

California

C.A.R. The number written into your contract beats any printed default. The executed contract controls, so confirm every date with the agent, broker or attorney on the file.

Watch the time of day as well: 11:59 p.m. Mountain Time in Colorado unless the contract sets another time, 11:59 p.m. in California, and 9:00 p.m. under the NWMLS forms.

How does the buyer give notice before the financing deadline?

Almost every form wants written notice, delivered the way the notice paragraph says, and received by the deadline. A phone call saying underwriting is still working on it does nothing.

In Texas, the buyer delivers a notice of termination and a copy of the lender’s written statement setting out the reasons. Without the lender’s statement, the termination does not fit the addendum.

In Colorado, the Notice to Terminate must be received on or before the deadline. Under section 24.1, a notice received late has no effect.

In California, within the loan contingency period, the buyer either removes the contingency in writing or cancels.

What happens if the buyer misses the financing contingency deadline?

The answer changes by form, and the differences are large.

In Texas, if the buyer does not terminate in time, “the contract shall no longer be subject to the Buyer obtaining Buyer Approval.” If the loan fails later for a buyer reason, the earnest money is exposed. Property Approval is a separate right that runs to the 3rd day before closing.

In Colorado, a party who does not give timely notice accepts the condition and waives the right to terminate. The contract adds that if the seller is not in default and does not timely receive the buyer’s written notice, the earnest money becomes nonrefundable, with exceptions such as appraisal, title and survey.

In California, the contingency does not vanish on its own. The seller must first deliver a Notice to Buyer to Perform giving at least 2 Days, and until the seller cancels, the buyer can still remove the contingency or cancel in writing.

A missed date does not always end the deal, but it changes who has the upper hand while the loan is still in underwriting.

Worked example: one effective date, five state forms

Say the effective date is Monday, November 2, 2026, and closing is written as Friday, December 11, 2026. Here is where the financing date lands under each form’s default.

Form

Rule

Deadline

California RPA

17 days after Acceptance

Thursday, November 19, 2026

Texas TPFA

Buyer Approval, if 21 days is written in

Monday, November 23, 2026 (Property Approval: Tuesday, December 8)

Washington Form 22A

21 days

Monday, November 23, 2026

Florida AS IS

30 days

Wednesday, December 2, 2026

Illinois Multi-Board 8.0

Earlier of 45 days (December 17) or 5 Business Days before closing

Friday, December 4, 2026

The Illinois row catches people. Forty-five days sounds roomy, but with a 39-day closing the 5 Business Day limit wins by 13 days. Calendar December 17 by mistake and the buyer’s protection is gone two weeks before anyone notices.

The Texas row shows the split. Buyer Approval ends November 23 and never moves. Property Approval is counted back from closing, so it moves if closing moves.

How do you extend a financing contingency deadline?

With a written amendment signed by all parties before the current deadline passes. In Texas, the TREC Amendment to Contract (TREC No. 39-11) has a line for changing the date the buyer must give notice that Buyer Approval cannot be obtained. In date-table states such as Colorado, the amendment replaces the date in the table.

Moving closing does not move a financing date counted from the effective date. If you extend closing, decide on purpose whether the financing date moves too, and write it in.

Our coordinators set two reminders for every financing date: a week out to request written lender status, and two days out to confirm the plan with the agent. The AI layer from ReBillion reads the contract and drafts the timeline, and a human coordinator checks every date against the signed pages.

Frequently asked questions

Is the financing contingency deadline the same as the closing date?

No. The financing deadline usually lands weeks before closing. It is the last day the buyer can cancel because the loan failed and keep the earnest money protection. Closing is when the deal funds. Illinois ties the two together: the Multi-Board financing date is 45 days after acceptance or 5 Business Days before closing, whichever comes first.

Does the financing contingency deadline move if it falls on a weekend?

It depends on the form. The C.A.R. form, the Florida AS IS contract, NWMLS Form 22A and the Illinois Multi-Board contract move it to the next business day. The Texas Buyer Approval date does not move. In Colorado it moves only if the Will box is checked in section 3.3.3. Read your own contract to confirm.

Can a buyer still cancel over a low appraisal after the financing deadline?

Sometimes, because many forms treat the appraisal separately. In Texas, Property Approval under the financing addendum runs until the 3rd day before closing, after Buyer Approval has ended. Colorado has its own Appraisal Deadline. In other forms one deadline covers both the loan and the appraisal. Calendar each one separately.

Who is responsible for tracking the financing contingency deadline?

The buyer’s agent owns the advice and the notice. The transaction coordinator puts the date on the calendar, asks the lender for written status ahead of it, and flags the file if approval looks late. The lender does not track your contract deadline for you. Confirm the date with your broker or attorney if the contract wording is unclear.

Want your file’s financing date beside every other deadline?
